Dear Cindy:
I am a Canadian citizen living in Canada. I have a diploma as a human services counselor, specializing in mental health and addictions. I have used a J-1 exchange visitor visa and worked in New Hampshire already. Is there another visa that I can use to get a job in the USA? Right now I am working with the government as an agent in the pension office, and I also work part-time in a facility for disabled and developmentally challenged people.

Sincerely,

M

Dear M:
Unfortunately, I don't know of any work visa for which you would qualify. You do not qualify under the NAFTA TN visas' mental health/social services professional options, since you are not a licensed social worker or psychologist, nor are you a vocational counselor with at least a Bachelor's degree. You also do not qualify for the non-immigrant H-1B, which is for those in a specialty occupation who hold at least a Bachelor's in the field and who are applying for a position requiring at least a Bachelor's. Nor, based on the information provided about your work and education, do you qualify for the immigrant EB-2 or EB-3 visas (for information see the USCIS brochure or the State Department's page on the EB visas, which are referred to there as E visas).

I'm sorry that I can't provide more positive information.
